What is a K-3 Visa?
The K-3 visa is a nonimmigrant visa that allows foreign nationals who are married to U.S. citizens to enter the United States and wait for their green card application to be processed. This visa is valid for two years and can be renewed as long as the marriage is still valid.

- Foreign National Spouse: The foreign national spouse must have a valid passport and must not have any criminal convictions or other issues that would make them ineligible for a U.S. visa.
It’s important to note that if either spouse has been previously married, they must provide proof that any previous marriages have been legally terminated before applying for a K-3 visa.
Application Process
The first step in applying for a K-3 visa is filing Form I-129F, Petition for Alien Fiancé(e). This form must be filed by the U.S. citizen spouse with U.S Citizenship and Immigration Services (USCIS). Once USCIS approves the petition, it will be sent to the National Visa Center (NVC) where it will be processed.
Once the NVC has received the petition, they will send instructions on how to apply for a K-3 visa at a U.S embassy or consulate abroad. The foreign national spouse will then need to submit all required documents and attend an interview at the embassy or consulate.
