What is a CR1 Visa?
A CR1 visa is a type of immigrant visa that allows a foreign spouse of a U.S. citizen to enter the United States and become a permanent resident. The CR1 visa is also known as an immigrant spousal visa or marriage visa.
The CR1 visa is valid for two years and can be renewed if the couple remains married and living together in the United States. After two years, the foreign spouse can apply for permanent residency (a green card) through adjustment of status.
Eligibility Requirements
In order to be eligible for a CR1 visa, both the U.S. citizen and their foreign spouse must meet certain requirements. The U.S. citizen must be able to prove that they are financially capable of supporting their foreign spouse in the United States, and they must also prove that their marriage is legitimate.
The foreign spouse must also meet certain eligibility requirements, such as having no criminal record and being free from certain communicable diseases.
Application Process
The application process for a CR1 visa can be complex and time-consuming, so it’s important to understand all of the steps involved before beginning your application.
The first step is to file Form I-130, Petition for Alien Relative, with U.S. Citizenship and Immigration Services (USCIS). Once USCIS approves your petition, you will then need to file Form DS-260, Immigrant Visa Application, with the Department of State’s National Visa Center (NVC). After NVC approves your application, you will then need to attend an interview at a U.S. embassy or consulate in your home country.
USA ESTA
If you are planning on traveling to the United States while your CR1 visa application is pending, you may need to apply for an USA ESTA. An ESTA is an electronic travel authorization that allows travelers from certain countries to enter the United States without a visa.
An ESTA is valid for two years or until your passport expires, whichever comes first, and can be used for multiple trips within that period of time.
